By accessing the Window Shopper website (“Site”) or using the services offered by Window Shopper (“Services”) you agree and acknowledge to be bound by these Terms of Service (“Terms”). You may not use the Window Shopper site and or its services to transmit any content which:
harasses, threatens, embarrasses or causes distress, unwanted attention or discomfort upon any other person, includes sexually explicit images or other content which is offensive or harmful to minors, includes any unlawful, harmful, threatening, abusive, harassing, defamatory, vulgar, obscene, or hateful material, including but not limited to material based on a person’s race, national origin, ethnicity, religion, gender, sexual orientation, disablement or other such affiliation, impersonates any person or the appearance or voice of any person, utilizes a false name or identity or a name or identity that you are not entitled or authorized to use, contains any unsolicited advertising, promotional materials, or other forms of solicitation, contravenes any application law or government regulation, violates any operating rule, regulation, procedure, policy or guideline of Window Shopper as published on the Window Shopper website, may infringe the intellectual property rights or other rights of third parties, including trademark, copyright, trade secret, patent, publicity right, or privacy right, distributes software or other Content in violation of any license agreement.
Limitation on Liability
In no event shall Window Shopper be liable to you or any third party for any indirect, consequential, exemplary, incidental, special or punitive damages, including lost profit damages arising from your use of the services, even if Window Shopper has been advised of the possibility of such damages, notwithstanding anything to the contrary contained herein.
Window Shopper, in its sole discretion, may terminate your membership and remove and discard any information associated with the membership without notice if Window Shopper believes that you have violated or acted inconsistently with the Terms. Window Shopper will not be liable to you for termination of your membership to the Service. Window Shopper, in its sole discretion, may delete any of the content posted to the Site and remove and discard any information associated with the content without notice if Window Shopper believes that you have violated or acted inconsistently with the Terms. Window Shopper will not be liable to you for deletion of the content. Window Shopper reserves the right at any time and from time to time to modify or discontinue, temporarily or permanently, the Service (or any part thereof) with or without notice. You agree that Window Shopper shall not be liable to you or to any third party for any modification, suspension or discontinuance of the Service. Indemnification
You agree to indemnify, hold harmless and defend Window Shopper, at your expense, against any and all third party claims, actions, proceedings, and suits brought against Window Shopper or any of its officers, directors, employees, agents or affiliates, and all related liabilities, damages, settlements, penalties, fines, costs or expenses (including, without limitation, reasonable attorneys’ fees) incurred by Window Shopper or any of its officers, directors, employees, agents or affiliates, arising out of or relating to (i) your breach of any term or condition of this Agreement, (ii) your use of the Service, or (iii) your unauthorized use of the Script code. In such a case, Window Shopper will provide you with written notice of such claim, suit or action. You shall cooperate as fully as reasonably required in the defense of any claim. Window Shopper reserves the right, at its own expense, to assume the exclusive defense and control of any matter subject to indemnification by you.

PRIVACY POLICY
The e-mail address you register with Window Shopper and the logs of your image-collecting activity may be used to calculate personalized recommendations as part of our service. We use this information in aggregate to generate statistics and other usage information. We share this information with you, and other end users. Data is only shared with third parties when we deem it necessary to provide a better end user service, such as customer support.

Upon request, we are happy to provide access to any site behavior data that we have collected about you. All requests for such data will be fulfilled within a 14-day period.
